Rennervations for Disney+ Auction of Surplus Vehicles
1. PAYMENT INSTRUCTIONS: a. To register and participate in our auction, you must be at least 21 years old and have a valid credit card on file. The first time you add a new card, a $100 soft hold will be placed to confirm available funds. This hold will automatically be released within 2-3 business days.
b. Your credit card on file will be charged immediately after the auction closes. If this doesn't occur, it will be charged within 24 hours.
c. If your credit card is declined, a $15 fee will be added to your invoice. Ensure your payment and contact information is correct and can cover the entire invoice. This fee also applies when processing payment for shipping.
d. To arrange an alternate form of payment (e.g., cash, cashier’s check, wire transfer), you must contact Thomas Hayward Auctioneers, LLC in writing at least 24 hours before the auction closes. If payment is not received by the pick-up deadline, your card on file will be charged for the full invoice amount, including applicable fees. Email us at thomashayward@charter.net to arrange alternate payment methods.
e. Cash payments must be made with exact change. No discounts for cash payments.
f. Personal or out-of-state checks are not accepted.
g. Cashier’s checks over $500 must be pre-approved by the Auctioneer.
h. Payments over $3,000 must be made by certified cashier’s check or wire transfer.
i. Wire transfers incur a $30 fee.
j. If your invoice is not paid within two business days of the auction closing, you may be banned from future auctions, affecting your ability to bid in any current or future auctions with Thomas Hayward Auctioneers, LLC.
2. PAYMENT OPTIONS: a. Thomas Hayward Auctioneers, LLC accepts:
- Discover, MasterCard, Visa, American Express
- Cash (US Currency Only)
- Cashier's Check
- Wire Transfers
3. PAYMENT INFORMATION: a. All purchases are in USD.
b. A 10% buyer’s premium applies to all winning bids.
c. Credit card transactions incur a 3% convenience fee.
d. Buyers agree not to initiate a chargeback under any circumstances. If a chargeback is initiated, the auction house reserves the right to ban the buyer from future auctions.
e. Transportation, storage, shipping, and handling fees are at the discretion of the Auctioneer.
4. PROPERTY INSPECTION: a. Limited in-person previews are available by appointment only. All inventory, unless specified otherwise, is located at 135 & 145 Esmeralda Drive, Reno, NV 89704 (Washoe Valley). The property is secured with video surveillance.
b. Additional photos, videos, or condition reports are available upon request. Please email Thomashayward@charter.net.
5. PICK-UP: a. Pick-up is available for 2 days only, by appointment. Bring a photo ID and your email invoice receipt.
b. All inventory is located at our warehouse facility in Reno, Nevada unless otherwise noted.
c. Buyers are responsible for loading, transportation, and disassembly of items. We do not provide tools or assistance with moving heavy objects.
d. To schedule pick-ups beyond the initial two-day window or to coordinate shipping, call 888-255-7633. Written permission is required for pick-ups on a buyer’s behalf.
f. Inventory not collected or without shipping arranged by the close of the second pick-up day will incur a minimum fee of $25 per lot, per day, for up to seven days.
g. Inventory remaining beyond seven days will be shipped to the address on file at the buyer’s expense, or if deemed unreasonable by the auctioneer, the item will be forfeited and relisted, disposed of, or donated at the buyer’s expense.
6. VEHICLE PURCHASES: a. Vehicles are subject to title transfer fees and any applicable registration fees.
b. Title transfers will only be made in the winning bidder’s name or their company’s name for commercial vehicles.
c. Transfer and registration fees are non-negotiable and the buyer’s responsibility.
d. Payment must be completed within two business days, and a power of attorney form must be completed for DMV titling.
e. Vehicle titles are typically transferred the same day if payment is received before 3:00 pm; otherwise, within 48 hours.
f. Vehicle mileage is accurate at the time of cataloging and may change slightly, not exceeding 25 miles beyond the advertised mileage.
7. BIDDING ONLINE: a. All bids placed are final. We do not retract bids. If you default on payment, you will be liable for the difference between your high bid and the final sale price of the lot.
b. The auction will close at a rate of three lots per minute. If a bid is placed within the last minute, the lot will be extended by one minute.
c. Online bidding increments are as follows:
- $0 - $50: $5
- $51 - $200: $10
- $201 - $500: $25
- $501 - $1,000: $50
- $1,001 - $10,000: $100
- $10,001 - $50,000: $250
- $50,001 - $100,000: $500
- $100,001 - $1,000,000: $1,000
- $1,000,001 - $5,000,000: $5,000
- $5,000,001 - $10,000,000+: $10,000
d. Bid increments are subject to change at the auctioneer's discretion.
e. Maximum Bids are placed at the reserve price if they exceed the reserve. If below the reserve, the bid will be placed at the full amount.
f. The auctioneer reserves the right to lift a reserve price at any time, guaranteeing a sale to the highest bidder.
g. Being the high bidder on an item, with or without reserve, is a commitment to purchase for the high bid amount.
8. CONDITIONS OF SALE: a. All property is sold “AS IS,” and ALL SALES ARE FINAL. Items may have wear, imperfections, or aging effects. Condition statements are opinions and not statements of fact. Buyers are encouraged to inspect items in person prior to bidding. Condition reports can be provided upon request. Thomas Hayward Auctioneers, LLC accepts no responsibility for errors or omissions.
b. Property is open to public inspection by appointment or by request for condition reports, photos, or videos. It is the Bidder’s responsibility to determine condition, age, authenticity, value, or any other factor. Thomas Hayward Auctioneers, LLC attempts to describe merchandise accurately but makes no guarantees. The Bidder is the sole judge of value and authenticity and may not contest any factor. Bidders participating off-site acknowledge that this affects their ability to inspect items. Thomas Hayward Auctioneers, LLC will not be responsible for errors or omissions unless it is a material and intentional misrepresentation. THERE ARE NO REFUNDS.
c. High/low estimates are courtesy only and not a guarantee of the sales price.
9. WARRANTIES OF OWNER/REPRESENTATIVE: a. The owner/representative warrants that they have merchantable title to the items offered for sale and grants the Auctioneer the right to convey this title to buyers. The owner/representative guarantees clear title, and if unable to provide it, they will be liable for pre-sale expenses incurred by the Auctioneer or a withdrawal fee.
b. Thomas Hayward Auctioneers, LLC provides Internet auction bidding as a service. The Bidder acknowledges that this service may not function correctly during the auction. Under no circumstances shall the Bidder have any claim against Thomas Hayward Auctioneers, LLC if the Internet service fails. Thomas Hayward Auctioneers, LLC will not be responsible for missed bids. Internet bidders should use the website feature and leave their maximum bid 24 hours before the auction ends. The auctioneer reserves the right to withdraw, re-sequence, or re-catalog items at any time for any reason.
10. GOVERNING LAW & VENUE: a. This agreement is governed by the laws of the State of Nevada. All disputes related to this agreement shall be resolved in a court located in Reno, Nevada.
11. ACCEPTANCE: a. By bidding in our auction, the Bidder acknowledges that they have read and agreed to the Terms & Conditions in their entirety. Thank you for your understanding and acceptance.
